1. Agreeing to these terms

These Terms & Conditions (“Terms”) are an agreement between you and Connor Byrne (“Rhythms”, “we”, “us”) for your use of the Rhythms app and this website (the “Services”). By downloading, accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

2. Who can use Rhythms

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf.

3. Your license to use the app

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Rhythms app on Apple devices that you own or control, as allowed by the App Store Terms of Service and Usage Rules. You may not copy, modify, distribute, sell, reverse engineer or create derivative works of the app, except where the law allows it.

4. Your account

You sign in with your Apple Account. You are responsible for keeping your device and Apple Account secure and for activity that happens through them. You can delete your account and everything in it at any time from your profile in the app.

5. App blocking and Screen Time

Rhythms uses Apple's Screen Time frameworks to pause apps while a rhythm is live. By using this feature, you understand that:

• blocking depends on Apple's software and your device settings, and may not work perfectly or in every situation;
• you choose which apps stay available, and you are responsible for keeping access to anything you might need, such as Phone, Messages, maps, medical apps or tools for work and school;
• if you turn off Emergency unblock for a rhythm, you may not be able to end it early from within Rhythms; and
• emergency calling provided by iOS is not controlled by Rhythms.

Please don't rely on Rhythms in situations where limited access to your phone could put you or others at risk.

6. Alarms and reminders

Alarms and reminders are scheduled through your iPhone and depend on its settings, permissions, battery and Focus modes. We do our best to make them dependable, but we can't guarantee that every alarm or reminder will be delivered.

7. Spiritual content, not professional advice

Rhythms is a devotional tool. Prompts, check-ins, heart posture summaries and other content are for personal reflection. They are not pastoral counseling, medical, mental health or other professional advice, and they are not a diagnosis. If you are struggling, please reach out to a pastor, a trusted friend or a licensed professional. If you are in crisis in the United States, call or text 988, or contact your local emergency number.

8. Scripture

Scripture in the app is from the World English Bible, which is in the public domain.

9. Your content

You own what you create in Rhythms, such as rhythms, reflections, prayers and notes. It is stored on your device and in your private iCloud, and we claim no ownership of it and have no access to it. You are responsible for backing up anything you want to keep.

10. Giving and purchases

Rhythms is 100% free. Giving is entirely optional and does not unlock features or content.

Monthly support in the app

Monthly support options are auto-renewable subscriptions sold and billed by Apple through your Apple Account. They renew each month until you cancel, and you can manage or cancel them at any time in Settings › [your name] › Subscriptions. Cancelling stops future charges; it does not refund the current month. Refunds are handled by Apple under its policies.

One-time gifts on the website

Gifts made on this website are voluntary and processed by a third-party payment processor under its own terms. Gifts are generally non-refundable, but if you made a mistake, contact us within 30 days and we'll make it right. Rhythms is not a registered charity, so gifts are not tax-deductible.

11. Acceptable use

Please don't misuse the Services. For example, don't interfere with or disrupt them, try to access them in ways we haven't intended, use them to break the law, or use them to harm anyone.

12. Our content and trademarks

The Services, including their design, software, text, graphics, icons and the Rhythms name and logo, belong to us or our licensors and are protected by law. Apart from the license in section 3, these Terms don't give you any rights to them. Fonts and other third-party materials are used under their own licenses.

13. Third-party services

The Services rely on third parties such as Apple (for the App Store, Sign in with Apple, iCloud and Screen Time) and our payment processor. Their terms and privacy policies apply to your use of their services, and we are not responsible for them.

14. Apple App Store terms

If you downloaded Rhythms from the App Store, you and we also acknowledge that:

• these Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the app and its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation for the app;
• we, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
• we, not Apple, are responsible for investigating, defending, settling and discharging any claim that the app infringes a third party's intellectual property rights;
• you represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties;
• you must comply with applicable third-party terms (such as your wireless carrier's) when using the app; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

15. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Services will be uninterrupted, error-free or secure.

16. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, use, goodwill or profits, arising from or related to your use of the Services. Our total liability for any claim related to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.

Some places don't allow these limits, so they may not all apply to you. Nothing in these Terms limits rights you have that can't be limited by law.

17. Indemnity

To the extent permitted by law, you agree to defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms.

18. Ending your use

You can stop using the Services at any time by deleting your account and the app. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we stop offering the Services. Sections that by their nature should survive, such as ownership, disclaimers and limits of liability, will survive.

19. Changes to these terms

We may update these Terms from time to time. We'll post the new version here and update the date above, and if a change is significant, we'll let you know in the app or on this site before it takes effect. Continuing to use the Services after a change means you accept the updated Terms.

20. Governing law and disputes

These Terms are governed by the laws of the State of [State], United States, without regard to its conflict of law rules. Before filing a claim, you agree to contact us and try to resolve the issue informally for at least 30 days. Any dispute that can't be resolved informally will be handled in the state or federal courts located in [County], [State], unless the law where you live gives you the right to bring it elsewhere.

21. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. If we don't enforce a provision, that isn't a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a transfer of the Services.
